According to learned counsel for the petitioner, case is covered by the judgment delivered by the Apex Court in the case of O.K.Bhardwaj vs. Union of India and Ors., reported in 2001 (9) SCC 180.
Learned counsel for the respondents opposed the prayer on the ground
that instant case bears different factual details. Here, the petitioner inflicted with minor penalties and therefore, O.K.Bhardwaj in specific terms does not apply. He relied upon the order dated 08.09.2020 delivered by the Division Bench of this Court in bunch of Writ Appeals in which Writ Appeal No.761/2020 (Ratan Singh Silawat vs. The State of M.P. & Others) is a lead case to bring home the analogy that departmental inquiry can be dispensed with in matters of minor punishments.
At this juncture, learned counsel for the petitioner sought time to bring certain judgments of the Division Bench of this Court as well as the Apex Court
to demonstrate that in case of minor penalty also, departmental inquiry is required.
