Appellants as plaintiffs have filed this appeal under Section 100 of CPC against the judgment and decree dated 24/11/2021 passed by 3rd District Judge,
Dabra in Civil Appeal No. 4/2017 (Veer Singh and Ors. Vs. Smt. Manorma and Ors.) dismissing the appeal and affirming the judgment and decree dated 5/12/2016 passed by 1st Civil Judge, Class-I, Bhitarwar, District Gwalior in Civil Suit No. 01-A/2015 (Veer Singh and Ors. Vs. Smt. Manorma and Ors.) whereby, suit filed by appellants for declaration of title and cancellation of sale deed has been dismissed.
The appeal is admitted on following substantial question of law:-
"Whether, learned Courts below erred in misinterpreting the devolution of rights to be under Section 8 of Hindu Succession Act."
Issue notice to respondents No. 1 to 3 for final hearing by RAD post on payment of process fee within seven working days. Notice be made returnable within six weeks.
