Shri Bhagwan Singh Thakur submits that the issue is as to whether in an election petition, one of the parties can call representatives of the State, who

had conducted the elections for cross-examination or not and the another issue is as to whether the issues were required to be framed as are framed in a civil suit or not. The aforesaid issue is answered by the High Court of Chhattisgarh on 28.1.2016 in Writ Petition (C) No.1565/2015.

Shri Swatantra Pandey prays for time to go through the said judgment and address the Court.

List on 1.12.2023.

The State is directed to file reply in the meantime. Interim order, if any, shall remain in operation till then.
