Issue notice to the respondent. Returnable within four weeks. Lower Court record be summoned within three weeks from today. Order on IA No.25219/2023.

Heard learned counsel for the accused-revisionist and Government Advocate appearing for State and perused the record.

This application is filed by the revisionists-accused arising out of judgment dated 10.10.2023 passed by the Sessions Judge, Narsinghpur in Criminal Appeal No.245/2023 affirming the conviction under Section 498-A of

IPC and sentencing him to undergo R.I. for one year with fine of Rs.500/-, under Section 323 of IPC and sentencing him to undergo R.I. for six months with fine of Rs.200/- and under Section 4 of Dwory Prohibition Act and sentencing him to undergo R.I. for six months with fine of Rs.200/-, with default stipulations.

Learned counsel for the revisionists submits that though the revisionist- accused is husband but he has not committed any offence. He has been falsely implicated in the case. the evidence properly. Accused-revisionist was on bail during the pendency of the trial and appeal and he has not misused the liberty of bail. The final disposal of this revision will take considerable time.

Learned Government Advocate for the State has opposed the application.

Considering the facts and circumstances of the case, without commenting upon the merits of the case, it is directed that revisionist be released on bail on his furnishing a personal bond of Rs.50,000/- (Rupees Fifty Thousand) with two sureties for the like amount to the satisfaction of trial court concerned during the pendency of this revision within an undertaking that

he will not misuse the liberty of bail and indulge in any criminal case. The fine amount imposed by the trial Court shall be deposited before his release, if not already deposited.

On the condition enumerated above, the order of trial Court shall remain suspended till disposal of the present revision.

The application is disposed of accordingly. List the matter for final hearing in Second week of February, 2024.
