Heard on I.A. No. 7395/2023, first application under Section 389 (1) of Cr.P.C. moved on behalf of appellant No.1-Mahendra Ahirwar and appellant No.2- Dinesh Ahirwar.

Criminal appeal under Section 374 of the Cr.P.C. is preferred by the appellants against the judgment dated 12/04/2023 passed by Fourth Additional Sessions Judge, District Vidisha (M.P.) in ST. No.65/2019 whereby appellant

No.1 Mahendra Ahirwar has been convicted under Section 324 of IPC and sentenced to suffer 2 years' RI with fine of Rs.1,000/- and under Section 25 (1-B)(B) of IPC and sentenced to suffer 2 years' RI with fine of Rs.1,000/- and appellant No.2 Dinesh Ahirwar has been convicted under Section 308 of IPC and sentenced to suffer 3 years' RI with fine of Rs.3,000/-with default stipulation.

It is the submission of learned counsel for the appellants that appellant No.1 Mahendra Ahirwar suffered more than one year of jail incarceration as pretrial detention, whereas appellant No.2 Dinesh Ahirwar suffered 11 months of jail incarceration as pretrial detention. Appellant No.1- Mahendra has been

convicted to suffer two years of jail sentence, whereas appellant No.2- Dinesh has been convicted to suffer three years of jail sentence. Since the appellants have already suffered sufficient period of custody, therefore, their case may be

considered for suspension of jail sentence. Hearing of appeal will take time and they have a strong case on merits. On these grounds, prayer for suspension of sentence has been made out. Appellants further undertake to perform community 2 of 4

service to purge their misdeeds, if any, by way of plantation and to serve national/environmental/social cause voluntarily. Thus, prayed for suspension of sentence and grant of bail.

Learned counsel for the respondent/State opposed the prayer and prayed for rejection of application.

Considering the facts and circumstances of the case, this Court intends to allow the application with stringent conditions, subject to deposit of fine amount,

it is directed that jail sentence of appellant No.1-Mahendra Ahirwar and

appellant No.2- Dinesh Ahirwar shall remain suspended subject to furnishing a

personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of like amount to the satisfaction of the trial Court to

appear before Registry of this Court on and all other subsequent

dates as may be fixed in this regard.

Appellant No.1-Mahendra Ahirwar and appellant No.2- Dinesh

Ahirwar shall not move in the vicinity of the complainant side in any manner and would not cause any embarrassment or harassment to the complainant side, otherwise their benefit of suspension shall immediately be withdrawn.

It is expected from the appellants that they shall submit photographs by downloading the mobile application (NISARG App) prepared at the instance of High Court for monitoring the plantation through satellite/Geo- tagging/Geo fencing.
