                                    Heard on admission.
                                    Counsel for the petitioner submits that the suit filed by the petitioner was
                           dismissed. Against the said judgment and decree, the petitioner filed first appeal
                           before the Court, however, the said appeal has been dismissed on the statement
                           of the Advocate that because of lackadaisical attitude of the petitioner/appellant,

                           he does not want to press the appeal.
                                    Counsel for the petitioner submits that no such instruction was given to
                           the counsel by the petitioner. The aforesaid assertion is supported by an
                           affidavit of the petitioner.
                                    Issue notice to the respondent No. 1 on payment of PF by registered

mode within one week, returnable within four weeks.
