It is the grievance of petitioner that proceedings are pending before 17th District Judge Gwalior in respect of execution of order dated 24.07.2006

passed by 12th Additional District Jude (Fast Track Court) Gwalior (vide Annexure P/2).

Shri Gaurav Mishra, Advocate, who is present in the court room and usually appears for Municipal Corporation Gwalior is directed to accept notice on behalf of Municipal Corporation Gwalior and seek instructions in light of judgment of Apex Court in the case of Rahul s. Shah v. Jinendra Kumar Gandhi, AIR 2021 SC 2161.

Office is directed to reflect the name of Shri Gaurav Mishra, Advocate and associates on behalf of respondent/Municipal Corporation in the cause list.

For service of respondents No. 4 and 5, let process fee be paid within three days through RAD mode, returnable within two weeks.

Meanwhile, Shri Mishra is directed to seek instructions about the pendency of execution proceeding.
