After arguments at length, learned counsel for the applicant prays for withdrawal of this civil revision with liberty to avail appropriate remedy before the appropriate forum against the exparte judgment and decree passed in the civil suit with the support that in subsequent civil suit No.10A/2009 decided on 02.01.2012, the land in question has already been declared of the ownership of the State Government and the matter is still pending in the second appeal No.1129/2013.

Prayer being reasonable, is accepted and this civil revision is permitted to be withdrawn with the aforesaid liberty.

Interim application(s), if any, shall stand dismissed.

If any appropriate remedy is availed by the applicant within a period of two months, the same shall be decided by the concerning Court without being influenced by the impugned order passed by the executing Court.
