Heard on I.A. No.2558 of 2023 - an application under Section 389 (1) of the Cr.P.C. for suspension of sentence and grant of bail to the appellant.

B y the impugned judgment passed by the trial Court, the appellant has been

convicted for offences punishable under Sections 7/8 of the Protection of Children from Sexual Offences Act and Section 452 of the Indian Penal Code and sentenced to undergo RI for 3 years with fine Rs.1,000/- for each offence with default stipulation.

Heard learned counsel for the parties. Though the sentence imposed on the appellant is RI three years, yet looking to the nature of offence, conduct of the appellant and evidence available on record, at this stage, this Court is not inclined to suspend the sentence imposed on the appellant.

Accordingly, I.A. No.2558 of 2023 is hereby dismissed. List the case for final hearing.
