Shri Mukesh Parwal, learned G.A. for the respondent Nos.1-4/State, on
advance notice.
The petitioner is aggrieved by the order dated 21/3/2023 whereby the respondent No.3 has appointed respondent No.5 as Pujari of Shri Ram
Mandir at village Badud Tehsil Sanawad District Khargone.
Counsel for the petitioner submits that the aforesaid temple is a private temple and not included in the list of Government Temples and,therefore, the respondent No.5 could not have been appointed as Pujari by the Collector. The said appointment is contrary to the judgment passed by the Apex Court in the case of State of M.P. Vs. Pujari Utthan Avam Kalyan Samiti reported in 2021 (10) SCC 222.
Considering the same, issue notice to the respondents on payment of P.F within 7 working days by registered mode with due acknowledgement,
returnable within 4 weeks.
It is directed that appointment of respondent No.5 as Pujari shall be subject to final outcome of the petition. Further, the respondent No.5 shall not alienate the property of the deity.
