The counsel for the respondents No.4 and 5 prays for and is granted two weeks' time to file return.
It is submitted by the counsel for the petitioner that in the meanwhile, the respondents shall take possession of the property, therefore, her possession may be protected.
It is submitted by Ms. Dubey that the Bank had approached the DRT, Jabalpur in O.A.No.306/2018 and judgment dated 1.12.2018 was passed against the petitioner.
The proceedings for recovery are pending before the Competent Court. Even the petitioner has approached the DRT under Section 17 of SARFAESI Act.
Shockingly, all above-mentioned facts are missing from the writ petition. Under these circumstances, this Court is not inclined to issue any interim protection to the petitioner.
