      T h is petition coming on for hearing this day, JUSTICE ROHIT
ARYA passed the following:
                                   ORDER

Petitioners/Union of India are before this Court taking exception to the order passed by the Central Administrative Tribunal, Jabalpur, in the matter of extension of benefit of Rs.100/- per month medical allowance to the applicant

who admittedly opted for fixed medical allowance as evident from Annexure R/1 referred to in the impugned order.

The Tribunal has relied upon the Judgment of Punjab & Haryana High Court dated 09/04/2019 passed in Civil Writ Petition No.10110/2016 (Braham Prakash Versus Union of India and Others) wherein Resolution No.45/86/97- P&OW(A) dated 30.09.1977 has been relied upon to extend the benefit.

Since the Tribunal has found parity in the matter of awarding of fixed medical allowance to the applicant, we see no reason to interfere.

Consequently, this Misc. Petition sans merits and is hereby dismissed.
