This appeal is admitted on the following substantial questions of law:-
(i) Whether the finding recorded by the lower appellate court "that
there is likelihood of plaintiffs' dispossession in proceedings under Section 250
MPLRC" is sustainable especially in view of the admitted fact that suit is in
respect of Khasra No. 37 whereas proceedings under Section 250 are in respect
of Khasra Nos. 38 and 39 ?
(ii) Whether the lower appellate court committed an error of law in
reversing the well reasoned judgment and decree passed by the trial court
without even meeting the reasoning given by the latter ?
Issue notices to the respondents on payment of process fee within seven
working days by both modes for final hearing of this appeal.
