This First Appeal has been filed by appellant-wife challenging the judgment and decree dated 18.11.2021 passed by 1st Additional Principal Judge, Family Court, Bhopal in RCSHM No. 1433/2018 whereby petition for divorce filed by appellant-wife has been dismissed.

This appeal was admitted for final hearing on 20.01.2022. After service of notice, the respondent appeared and filed reply (document No. 3888/2022) supported by an affidavit contending therein that upon filing application for divorce before 2nd Additional Principal Judge of Family Court, Arera Hills, Bhopal, decree of divorce has been granted in Civil Suit No. 382/2017 vide judgment and decree dated 28.06.2017. Because copy of judgment passed in Civil Suit No. 382/2017 ( in the decree number of case is mentioned as Civil Suit No. 382-A of 2017) was not placed on record, therefore, respondent was directed to file copy of the judgment, whose decree is filed as Annexure R-1.

Learned counsel for the respondent submits that he has already applied for certified copy of the judgment but he has not been delivered the same by the concerning Court for the resasons not known to him. He is granted further four weeks time to obtain the certified copy of the judgment whose decree is filed, as Annexure R-1.
