Let record of the Court below be called for. Heard on I.A.No.9367/2022, first application under Section 397 of Cr.P.C. filed on behalf of petitioner for suspension of sentence and grant of bail.

This revision under Section 401 read with section 397 Cr.P.C. has been filed agaisnt the judgment dated 6.6.2022 passed by Additional Sessions Judge, Lahar, District Bhind in Criminal Appeal No. 1/21.

Learned counsel for the petitioner submitted that against the acquittal of the petitioner State has filed appeal which was allowed and the judgment of acquittal dated 11.2.2021 passed by JMFC Lahar in Criminal CAse No.700896/14 was set aside and the petitoiner was convicted under section 506-B of IPC and sentenced him to suffer six months RI with fine of Rs.500/-, under section 25(1-b)(a) of Arms Act sentenced to suffer one year RI with fine

of Rs.1000/-with default stipulation.

Learned counsel for the appellant submits that the fine amount has already been deposited. The revision is of the year 2022. There are fair chances of success of this revision and may take long time for its conclusion and the petitioner cannot be kept in custody for an unlimited period. Under these circumstances, he prays that the execution of sentence be suspended and he be released on bail.

On the other hand, the application is opposed by the Counsel for the State.

Considering the facts and circumstances of the case, I.A.No.9367/2022 is allowed. On depositing the fine amount (if not deposited by the petitioner ), the remaining jail sentence of petitioner shall remain suspended and he shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- (Rupees twenty five thousand) to the satisfaction of trial Court for his appearance before the Registry of this Court on 19.12.2022 and on all other subsequent dates as may be fixed by the office.
