respondent / State.

Heard on admission.

The petitioner before this Court has filed the present writ petition

being aggrieved by denial of two advance increments in view of the

provisions of FR-22D on account of his promotion from the post of

Assistant Teacher to the post of Head Master Primary School.

Learned petitioner's counsel at the outset has argued before this

Court that the controversy involved in the present writ petition is

squarely covered by the judgment delivered by this Court in the case

of State of MP Vs Dayaram Patidar on 04.10.2002 in W.P. No.1104

of 2001 and, therefore, petitioner is entitled the same benefit as has

been extended to Shri Dayaram Patidar.

Learned Petitioner's counsel prays for disposal of the present

writ petition in the light of the judgment of Dayaram Patidar (supra).

Learned government advocate has fairly stated before this Court

that the present matter is squarely covered by the judgment delivered

in the matter of Dayaram Patidar (supra) and, therefore, the present

writ petition is being disposed of with a direction to the respondents to

examine the petitioner's case in the light of judgment of Dayaram HIGH COURT OF MADHYA PRADESH, BENCH AT INDORE Writ Petition No.675/2022 (Dayaram Rathore Vs. State of M. P. and Others)

Patidar passed in W.P. No.1104 of 2001 and to pass necessary orders

positively within a period of six months from the date of receipt of

certified copy of this order.

It is needless to mention that in case petitioner is found eligible

for grant of the benefits as has been extended to Mr. Dayaram Patidar,

the same consequential benefits shall also be granted to the petitioner.

With the aforesaid direction, the present writ petition stands

disposed of with no orders as to costs.
