The judgment by the Trial Court was pronounced on 21.6.2016
and the appellant was not present on the said date and he was arrested
later on and has been awarded the jail sentence on 26.2.2019.
In view of the order dated 16.9.2021, the appellant has filed the
copy of order dated 8.8.2019 passed by Additional Sessions Judge,
Mainpuri (U.P.).
The reasons for absence of the appellant on the date of delivery of
original judgment cannot be said to be sufficient.
At this stage, the counsel for the appellant seeks permission of this
Court to withdraw the second application (I.A. No.20146/2021) for
suspension of sentence and grant of bail.
The application (I.A.No.20146/2021) is dismissed as
withdrawn.
