This Misc. Petition under Article 227 of the Constitution of India is at the behest of the petitioner/defendant taking exception to the order dated 24.03.2021 passed in Civil Suit No. 174A/2018. By the said order, the trial Court has rejected the defendant's application filed vide IA No. 2/2020 under Section 10 of the Code of Civil Procedure.
Upon hearing learned counsel for the parties, this Court refrains from commenting anything on rival contentions advanced and the impugned order, however it shall be expedient to order that the proceedings in Civil Suit No. 174A/2018 pending in the Court of First Civil Judge Class-2, Bhind may go on but no final judgment shall be passed till disposal of Civil Suit No. 92A/2018 pending in the Court of Civil Judge Class-1, Bhind. The trial Court is directed to decide Civil Suit No. 92A/2018 as early as possible, preferably within a period of nine months.
With the aforesaid, misc. petition stands disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case.
Let a copy of the order passed today be sent to the concerning trial Courts for compliance.
