Shri Jaideep Sirpurkar, learned counsel for the petitioner.
Issue notices to the respondents on payment of process fee within seven
working days by RAD mode failing which this petition shall stand dismissed without further reference to the Court.
It is pointed out that although the petitioner was not a party to the sale deed. Despite of the same he was directed to pay the ad valorem Court fees. He has
placed reliance upon the judgments passed by this court in the case of Ajay Pratap Singh and Others Vs. Kuldeep Singh and Others reported in 2013 (2) MPHT 236 and also in the case of Israt Jahan (Smt.) Vs. Rajia Begum and Others reported in 2010 (1) MPHT 338.
Considering the aforesaid, as an interim measure, the trial court is directed to proceed with the civil suit without pressurizing the petitioner to deposit the ad valorem Court fees till the decision of the petition.
List the matter in the week commencing 21.03.2022.
