This is second application filed under Section 439 of Cr.P.C.

for grant of bail. First application was dismissed as withdrawn by

order dated 28.4.2021 passed in M.Cr.C. No. 20616/2021.

The applicant has been arrested on 13.2.2021 in connection

with Crime No.260/2019 registered by Police Station Dehat Distt.

Ashoknagar for offence punishable under Sections 363, 376 (2) (n)

of IPC enhanced Section 366 (A) and 5 (L)/6 of POSCO Act.

It is submitted by Shri Tomar that DNA test report has been

received and DNA profile of the applicant is present in the

incriminating articles of the prosecutrix.

In view of the judgment passed by the Supreme Court in the

case of Hemudan Nanbha Gadhvi vs. State of Gujarat, reported

in (2019) 17 SCC 523, Counsel for the applicant seeks permission

of this Court to withdraw this application.

It is accordingly, dismissed as withdrawn.
