Heard on I.A.No.28220/2021, an application for condonation
of delay.
It is submitted by the counsel for the appellant that the
appellant is in jail. Since the family members were not aware of the
niceties of law and, therefore, the appeal could not be filed within
the period of limitation. There is a delay of six days in filing the
appeal. However, as per the Office report, the appeal has been filed
within 60 days after extending the benefit of Covid relaxation in the
light of the judgment passed by the Supreme Court dated 27.4.2021.
Be that whatever it may.
The appellant is in jail. Even according to the appellant, there
is a delay of six days only. Accordingly, I.A.No.28220/2021 is
hereby allowed. The delay in filing the appeal is hereby condoned.
