This petition under Section 482 of Cr.P.C. has been preferred by the petitioner for extension of time of interim bail granted by the trial Court in R.C.T. No.694/2020 vide order dated 10.06.2021.

It is submitted by the learned counsel for the petitioner- Suhil Shinde that the present petitioner is released on interim bail for 90 days vide order dated 10.06.2021 in the light of judgment passed by Hon'ble Apex Court as well as the main seat of this Court. He has further submitted that the aforesaid interim bail period is going to be expired on 8.9.2021. It is further submitted

that the trial Court is not have any power under Section 482 and the aforesaid order was passed in the light of judgment passed by the Apex Court as well as main seat of this Court and parties are arrived at compromise that shall be executed within 10 days of this order. Therefore, prayed to continue the aforesaid interim bail period for further 15 days.

Learned counsel for the complainant has submitted that the parties are going to compromise in the matter.

Learned counsel for the State vehemently opposed the same and has submitted that huge amount is involved in the matter and earlier order of grant of interim bail was passed by the trial Court, therefore, the aforesaid order can only be further extended by the trial Court.

Learned counsel for the petitioner submits that vide order dated 2 MCRC-44216-2021 13.10.2020 passed in M.Cr.C. No.36340/2021 the same matter has been disposed of on the basis of compromise made by the present petitioner with the complainant of other case, therefore, prayed to extend the aforesaid period of interim bail.

Perused the record available.

The case is registered under Sections 420, 406 read with Section 34 of

IPC.

Considering the aforesaid fact, in the interest of justice, the interim bail period is hereby extended for 15 days.

List this matter three days prior to expiry of aforesaid period. C.C. today.
