Petitioner; owner of a vehicle bearing registration No. MP10-A-9777 has approached this Court under Article 226 of the Constitution of India with the sole grievance that his application dated 20.07.2021(Annexure P-3) for grant of stage

carriage permit and application dated 27.08.2021 (Annexure P/5) for issuance of fitness certificate of the vehicle are pending consideration before respondent No.2 since 20.07.2021 and so far, the same have not been adverted to. Hence, prays for a direction for early decision of his applications.

At this stage, learned counsel for the petitioner submits that on similar facts and circumstances, this Court while disposing of W.P. No.3529/2019 on 05/04/2019 has observed that respondent No.2 shall decide the application bearing in mind the provisions as contained in Rule 77 (1b) of the M.P. Motor Vehicle Rules, 1994 and the judgment rendered by the Co-ordinate Bench in W.P. No.7703/2018 (Waheed Khan Vs. Transport Department).

Prayer of the petitioner appears to be innocuous. Hence, the writ petition is disposed of with following directions;

(i) petitioner is directed to submit certified copy of the order passed today before respondent No.2 within three working days from today;

(ii) respondent No.2 shall decide the applications of the petitioner, if not already decided, bearing in mind the aforesaid provisions of law and the judgment as referred above, within a period of two weeks therefrom with no exception.

With the aforesaid directions, the writ petition stands disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case.
