Heard on I.A. No.16330/2021, which is first application under Section 389(1) of the Cr.P.C. filed on behalf of the appellant for suspension of sentence and grant of bail.
The appellant has been convicted under Section 366 (K) of I.P.C. and sentenced to undergo rigorous imprisonment for 10 years with fine of Rs.1,000/- with default stipulations in ST No.16/2020 by the learned Additional Sessions Judge, Jabalpur, vide judgment dated 11.06.2021.
The appellant abducted the minor prosecutrix on 20.02.2018 and kept her as his wife. The prosecutrix/victim died on 04.06.2018 by consuming poison. At the time of death she was pregnant.
In view of the evidence of Rajni Chadhar (PW-1), Dhaniram Patel (PW-3), Suraj Patel (PW-4) and seizure memo (Exhibit P/8), no ground for
bail is made out.
Accordingly, I.A. No.16330/2021 is dismissed.
