This appeal seems to be arguable, hence admitted for final hearing. Records are already available.
Heard on I.A. No.18660/2021, which is an application filed under Section 389 (1) of Cr.P.C. for suspension of sentence and grant of bail to the appellant.
This criminal appeal is directed against the judgment dated 01.10.2021 passed in SC NDPS No.37/2019 by the Special Judge, NDPS Act, District Narsinghpur, whereby the appellant Akhilesh has been convicted under Section 8/20(b)(ii)B of NDPS Act and sentenced to under six months rigorous imprisonment with fine of Rs.3,000/- and in default to undergo additional imprisonment for one month.
Learned counsel submits that appellant is in jail and he has already suffered half period of jail sentence.
An early hearing of this appeal is not possible. Taking into consideration the facts and circumstances of the case, the I.A. is allowed.
It is, therefore, directed that if the appellant deposits the entire fine amount, if not already deposited, and furnishes a personal bond in the sum of Rs.50,000/-(Rupees Fifty Thousand) with a solvent surety in the like amount, to the satisfaction of trial Court for his appearance before the
Registry of this Court on 21st March, 2022 and on such subsequent dates as may be fixed in this regard, sentence of imprisonment awarded to him shall remain suspended till further orders and he shall be released on bail. Signature Not Verified SAN
