Heard on I.A.No.18642/2021, which is an application for under Section 389(1) Cr.P.C. for suspension of sentence and grant of bail to the applicant/appellant - Pappu @ Anil Yadav.

B y impugned judgment dated 30.09.2021 passed by the Ist Additional Sessions Judge, Tikamgarh (M.P.) in S.T.No.118/2017 the applicant has been convicted under Sections 120-B, 419, 420, 467, 468, 471/34 of the IPC and sentenced to R.I. for 5 years with fine of Rs.5000/-, R.I. for 3 years with fine of Rs.5000/-, R.I. for 5 years with

fine of Rs.5000/-, R.I. for 5 years with fine of Rs.5000/-, R.I. for 5 years with fine of Rs. 5000/- and R.I. for 3 years with fine of Rs. 5000/- respectively, with default stipulations.

Learned counsel for the applicant submits that fine amount has already been deposited by the applicant He has served sentence for about 09 months. Disposal of this appeal would take considerable time, hence, it is prayed that the jail sentence of the applicant be suspended and he be released on bail.

Considering the overall facts and circumstances of the case, the nature of offence and sentence awarded to the applicant,, without commenting upon the merits of the case, this application is allowed.

I t is directed that subject to depositing the fine amount, if not 2 CRA-6202-2021 already deposited and on furnishing a personal bond in a sum of Rs.50,000/-(Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the trial Court concerned, remaining jail sentence imposed upon applicant - Pappu @ Anil Yadav shall remain suspended during the pendency of this case and he shall be

released on bail.

The appellant shall appear before the Registry of this Court on 29.04.2022 and on all such subsequent dates, as may be fixed in this regard during pendency of this appeal.

List for final hearing in due course.
