Charge sheet has been issued by the Chief General Manager, who is not the competent authority.

It is pointed out that the Superintending Engineering was also found

involved regarding the alleged misconduct, therefore, the proposal was prepared and sent for approval to the highest authorities. The authority has considered the aforesaid aspect and has given approval for issuance of the suspension order and subsequent charge sheet, but the aforesaid documents are not on record.

Three days time is granted to place the aforesaid documents on record alongwith reply pointing out the aforesaid defect.

As the counsel for the petitioner has prayed for interim relief in the matter placing reliance on D.B. judgment passed in W.A. No. 221 of 2015 in

the case of M.P. Audyogik Kendra Vikas Nigam Bhopal Ltd. and anr. Vs. H.N. Raghuvanshi and others, list the matter on Tuesday, i.e. on 23.11.2021.
