At the outset, learned counsel for the appellant fairly informs this Court that in view of the office objection and in view of the judgment of this Court in the case of Sunita Gandharva Vs. State of M.P., 2020 (3) MPLJ

(Cri.) 247, later on affirmed by Division Bench of this Court at Jabalpur in the case of Pramod Yadav Vs. State of M.P. 2021 JLJ (2) 429 he seeks withdrawal of this appeal with liberty to file regular bail application under Section 439 of Cr.P.C.

Prayer accepted.

Appeal is dismissed as withdrawn with aforesaid liberty. Office is directed to return certified copy of impugned order to the appellant after its replenishment with photocopy.
