This second application under Section 439 of Cr.P.C. has been

filed for grant of bail. Previous application was rejected by order

dated 13.8.2021 passed in M.Cr.C. No.40244/2021.

The applicant has been arrested on 18.07.2021 in connection

with Crime No.107/2021 registered at Police Station Basai Distt.

Datia for offence under Section 34 (2) of M.P. Excise Act.

The first bail application was dismissed by the coordinate

Bench of this Court, however, on account of transfer of the Hon'ble

Judge, the matter has been listed before this Court. The first bail

application was dismissed in light of the fact that the applicant has a

criminal history and 17 more criminal cases were registered against

him and, accordingly, it was directed that at the time of repeat

application, the applicant shall point out the outcome of the criminal

history. However, the present bail application is completely silent

about the said aspect except filing the judgments passed in three

cases. Thus, it is clear that present application is not in accordance

with the direction given by the coordinate Bench of this Court.

Accordingly, the application is dismissed. However, the

applicant shall have liberty to repeat the application with the

complete documents thereby showing the outcome of the criminal

history.
