Agrawal, learned counsel for the respondent.

This Criminal Revision, under Section 397/401 of Code

of Criminal Procedure, has been filed against the order dated

07/06/2018 passed in Appeal No.120/2017 by 8 th Additional

Sessions Judge, Gwalior, whereby appeal preferred by the

applicant was partly allowed by modifying the order dated

02/02/2017 passed in Criminal Case No.8762/2011 (Manish

Bansal Vs. Sunil Gupta) and convicting the applicant under

Section 138 of Negotiable Instruments Act and sentenced to

suffer rigorous imprisonment of two years with fine of

Rs.6,90,000/-. In the appeal, the aforesaid punishment was

modified and the applicant has been sentenced till rising of the

Court and directed to deposit the fine amount within a period of

30 days with default stipulation of six months simple

imprisonment. It is further ordered that in case, fine amount is

not paid within a period of 30 days, then the same shall carry

interest at the rate of 9% per annum.

On 16/07/2018, this Court had issued notice to the

respondent and effect and operation of the impugned judgment

was stayed. Thereafter, on 27/11/2019, direction was issued to

deposit the compensation amount within a period of one week.

Today, no one appeared for the applicant.

It appears that the applicant has lost his interest in

prosecuting the case.

Accordingly, this Criminal Revision stands dismissed for

want of prosecution. Stay order passed by this Court stands

vacated. Needless to say that direction given by the Appellate

Court in order dated 07/06/2018 become operative.

A copy of this order be sent to the concerned court for

necessary information and compliance.
