This fourth application under Section 439 of Cr.P.C. has been
filed for grant of bail. The third application was dismissed by order
dated 27/1/2021 passed in M.Cr.C. No.2831/2021.
The applicant has been arrested on 15/2/2020 in connection
with Crime No.19/2020 registered at Police Station Dehat, District
Bhind for offence under Sections 363, 366-A, 376 of IPC and Section
5/6 of the POCSO, Act.
The previous bail application was dismissed by order dated
27/1/2021 passed in M.Cr.C. No.2831/2021 with liberty to revive the
prayer after the receipt of DNA test report. It is fairly conceded by the
counsel for the applicant that the DNA test report has not been
received so far. However, it is submitted that five months have passed
after the rejection of third bail application and the DNA test report
has not been received.
In the light of the judgment passed by the Supreme Court in the
case of Hemudan Nanbha Gadhvi Vs. State of Gujarat reported in

report is positively filed before the trial court within a period of two
months from today.
With aforesaid directions, the application is dismissed.
