Heard on I.A.No.12307/2020 filed under section 389 of CrPC on 6.11.2020 on behalf of applicant Arjun Swarastriya for suspension of substantive jail sentence.

Previously, on 27.6.2020 the first bail application filed on behalf of the applicant has been dismissed on merits. Except some more period of custody of applicant, no changed circumstance is found. 5 years RI has been awarded by the trial court for the offence under section 392/34 of IPC. The crime was committed with co-accused and the criminal background of the co-accused has been mentioned in Para 37 of the judgment.

Because no changed circumstance is found, hence the application is dismissed.
