Ms. Mamta Shandilya, learned government advocate for the
appellant.
Shri Bharat Sharma, learned counsel for the respondent
Nos.1 and 3.
Shri Sharma submits that the present appeal was filed by the State Government against the judgment of acquittal. The present respondents are in custody because of a different criminal case.
Considering the aforesaid, this Court on 13.04.2018 directed for issuance of production warrant for presence of respondent Nos.1 and 2.
In the meantime, in other criminal case, both the respondents aforesaid got bail. Yet they are kept in custody because of order dated 13.04.2018 despite the fact that their presence in the custody is not required in any other criminal case.
The present respondents are ready to furnish bail.
Ms. Shandilya, learned government advocate is directed to obtain instructions on this aspect.
