This first application under Section 439 of Cr.P.C. has been
filed for grant of bail.
The applicant has been arrested on 10.05.2021 in connection
with Crime No.115/2021 registered at Police Station Bhander Distt.
Datia for offence under Section 34 (2) of M.P. Excise Act.
It is submitted that according to prosecution case 60 bulk liters
of country made liquor has been seized from the possession of the
applicant.
However, it is submitted by Smt. Padam Shri Agarwal that the
applicant has criminal history and as many as 28 more criminal cases
have been registered against him.
In reply, it is submitted by Shri Sharma that he has filed copies
of the judgments passed in some of the criminal trials from which it
is clear that applicant was acquitted.
This Court has gone through the judgments passed in some of
the cases. It is apparent that in most of the cases, the applicant was
acquitted due to compromise or witnesses had not supported the
prosecution case.

Under these circumstances, this Court is of the considered
opinion that in the light of the criminal antecedents of the applicant,
no case is made out for grant of bail.
The application fails and is hereby dismissed.
