                                       the petitioner.
                                               Learned counsel for the petitioner has relied upon a judgment dated
                                       16.08.2018 passed          by a Division Bench of this             Court in W.P.

                                       No.12880/2018 (OMEGA Elevators vs. National Health Mission) filed by
                                       the petitioner earlier whereby the tender condition, incorporated by the
                                       National Health Mission, similar to the one impugned in the present writ
                                       petition, was set aside.
                                               Issue notice to the respondents by both modes, ordinary as well as by

registered A/d post, on payment of process fee within a week, returnable by four weeks.

In the meantime, the respondents shall provisionally accept the bid of t h e petitioner and subject to such bid being found to be technically

responsive on conditions other than above, they may proceed further to consider its financial bid but eventually, if the petitioner is found to be L-1, the Letter of Intent may not be issued in its favour save with the permission of this Court. However, if any other bidder is found to be L-1, the respondents may proceed to award the contract in accordance with law.
