The above two appeals have been filed at the instance of same appellant against the same judgment of conviction; hence, the connected appeal has been listed on the question of maintainability.
On the perusal of record, we have noticed that Cr.A No. 5391/2020 was filed without the affidavit of the appellant and without any Vakalatnama. Whereas, Cr.A No. 6338/2020 has been filed along with affidavit of the appellant as also duly executed Vakalatnama. That apart no one is appearing in Cr.A No. 5391/2020. Hence, Cr.A No. 5391/2020 is held to be not maintainable and is accordingly dismissed and Cr.A NO. 6338/2020 is held to
be maintainable.
Cr.A No. 6338/2020 is admitted for hearing. Counsel for the State prays for and is granted two weeks time to file objection to the suspension application.
