Heard on the question of admission. Perused the impugned judgment.

Appeal involves arguable points, hence, admitted.

Let record of the court below be called for. Also heard on IA No. 22821/2021, which is first application for suspension of sentence and grant of bail to appellant.

Appellant has been convicted under Section 326 of the Indian Penal Code and Sections 25(1-B)(B) and 27(1) of the Arms Act and sentenced to RI for three years with fine of Rs. 500/-, RI for one year with fine of Rs. 500/- and RI for three years with fine of Rs. 500/- respectively with default stipulation.

Learned counsel for the appellant submits that the trial court has

suspended the jail sentence of appellant till today and he is on bail. He submits that looking to the evidence collected by the prosecution and also the statements of the witnesses and that the final hearing of the appeal would take a long time, remaining jail sentence of appellant may be suspended.

Learned counsel for the respondent-State has opposed the bail application.

Considering the facts and circumstances of the case, without commenting anything on merit of the case, IA No. 22821/2021 is allowed.

It is directed that appellant be released on bail upon his furnishing a personal bond in the sum of Rs. 50,000/- with a surety bond of like amount to the satisfaction of trial Court concerned for his appearance before the Registry of this Court on 6.4.2022 and on such other dates as may be fixed by the Registry in this regard.
