Petitioner has filed this writ petition making a prayer to give direction to Collector Chhatarpur to consider and decide his pending representation.

Counsel appearing for the petitioner submitted that 4th Civil Judge

Class I, Chhatarpur has passed judgment and decree dated 08.01.2018 in favour of petitioner. He had filed an application that revenue authorities may act in accordance with judgment and decree but no action has been taken. It is submitted that judgment and decree is binding on revenue authorities and therefore, Collector may be directed to decide the representation of petitioner within limited time frame.

Panel Lawyer appearing for the State submitted that at this stage, he is not having any information whether State has preferred any appeal against said judgment and decree passed by the Civil Court. Any order passed by the

Civil Court will be subject to final order which will be passed in appeal, if any. It is further submitted that Collector will consider the representation of petitioner and if any appeal is filed by the State then Collector will take decision in accordance with law.

Considering the aforesaid submission, writ petition filed by the petitioner is disposed off with direction to Collector, Chhatarpur to consider and decide the representation filed by the petitioner dated 01.06.2019 in accordance with law. Petitioner is also directed to file a copy of fresh representation alongwith copy of this order before the Collector within a period of 15 days from the date of receipt of certified copy of this order. If such order is filed before Collector, then Collector shall act in accordance with law within further period of 60 days.
