under Section 439 Cr.P.C. in view of the judgment of Division Bench of this Court rendered in the case of Pramod Yadav vs. State of M.P. (Criminal Appeal No.5189/2020) dated 22.04.2021 and the order of Single Bench of this Court rendered in the case of Jitendra Rathore Vs. The State of M.P. and others (M.Cr.C. No.22493/2021) dated 23.06.2021.

On due consideration, the I.A. No.21205/2021 is allowed. Let necessary amendment be incorporated within a week and list thereafter.
