This is an application under Section 482 of the Code of Criminal Procedure, 1973 for quashment of F.I.R. dated 07.11.2020 registered at Crime No.106/2020, Police Station - Mahila Thana, Indore for the offences under Sections 498-A, 323, 294, 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The applicants are husband, mother-in-law, father-in-law and brother-in-law (represented by applicant No.1) of the respondent No.2 respectively.

The factual backdrop of the instant case is to the effect that applicant No.1 had married to respondent No.2 on 07.07.2019. Thereafter, bitterness developed between the two and they have made allegations and counter allegations against each other. However, with the passage of time, applicant No.1 and respondent No.2 have settled the dispute and differences with cool mind and due consideration of facts and circumstances. Applicant No.1 and respondent No.2 have filed a joint petition for divorce with mutual consent under Section 13(b) of the Hindu

Marriage Act before the Family Court.

Under such circumstances, both the parties pray for quashment of F.I.R. due to mutual settlement between the spouses in the light of the judgment of the Supreme Court in the case of Gian Singh v/s The State of Punjab & Another reported in (2012) 10 SCC 303.

Upon hearing learned counsel for the parties and in the considered opinion of this Court, no useful purpose shall be sub- served to keep this case pending.

Accordingly, the F.I.R. registered at Crime No.106/2020, Police Station - Mahila Thana, Indore for the offences under Sections 498-A, 323, 294, 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act and proceeding in respect of RCP No.8961/2020 stand quashed.

With the aforesaid, this M.Cr.C. stands disposed of. Certified copy, as per rules.
