The appeal has been filed against the judgment dated 07.12.2005 passed by First Additional Sessions Judge, Sendhwa (M.P.) in Session Trial No.224/2004 whereby the appellant has been convicted and sentenced as under:-

Section & Act. Imprisonment Fine Amount Imprisonment in lieu of default of payment of the fine.

302 of I.P.C. Life imprisonment Rs.300/- 1 month R.I. 323/149 3 months Rs. 100/- 7 day R.I.

During the pendency of the appeal the appellant no.2 Bersingh S/o Ghoti expired hence, his name has been deleted from the array of the appeal. So far as the appellant no.1 Munna S/o Bersingh is concerned the Jail Superintendent, Barwani has sent a letter dated 25.08.2021 to the A.G. Office that he has been released by the government on 15.08.2019 by giving the benefit of remission.

No one is appearing on behalf of appellant on the point of conviction hence, the appeal is finally disposed of.

Let record of the trial court be sent back along with judgment for compliance.
