Shri Hemant Tripathi, counsel for the applicant/appellant. Shri Manoj Kushwaha, Panel Lawyer for the State. There was a counter case registered on the complaint of the applicant. In that case, the complainant/injured of this case i.e. Benisingh Thakur has

been convicted by the trial Court and his appeal is pending before this Court wherein Benisingh Thakur has been granted suspension.

Learned counsel for the applicant submitted that he is not able to trace the counter appeal filed by Benisingh Thakur while he has referred to the counter case to buttress his contention in this case for suspension of sentence of the present appellant.

The information provided by the ld. counsel for the applicant is that Benisingh Thakur has been convicted in R.C.T. No.300813/2011 vide judgment dated 29.12.2016 passed by some Court in Jabalpur.

Office is directed to trace the appeal filed by Benisingh Thakur and place both the cases for hearing the suspension application of the present appellant.
