This first application under Section 439 of Cr.P.C. has been

filed for grant of bail.

The applicant has been arrested on 20/07/2021 in connection

with Crime No.77/2021 registered at Police Station Ghatigaon,

District Gwalior for offence under Sections 49(A) and 34(2) of

Excise Act.

At the outset, the counsel for the applicant seeks permission of

this Court to withdraw this application with liberty to file a fresh

application alongwith the judgments of acquittal passed in Crime

Nos.79/2007 and 95/2012.

With aforesaid liberty, the application is dismissed as

withdrawn.
