I.A. No.11593/2020:
The present is the first application under Section 389 Cr.P.C. on behalf of the appellant for suspension of sentence, who has been convicted for an offence punishable under Section 302/34 of the IPC and sentenced to undergo life imprisonment with fine of Rs.10,000/- and default stipulation as mentioned in the impugned judgment.
Upon hearing the learned counsel for the appellant and the learned Public Prosecutor; perusing the evidence on record and considering the antecedents of the accused-appellant against whom two more cases involving offence of murder have also been lodged, as is indicated in the reply submitted by the State, we are not persuaded to suspend the jail sentence awarded to the appellant.
Accordingly, I.A. No.11593/2020 is dismissed.
