W.P.(C) No.27903/2024 has been filed by the
Pamba Boat Race Club and another seeking to set aside
Ext.P14 order and to direct the 2nd respondent not to issue
orders prohibiting the 1st petitioner from conducting their annual
Pamba Boat Race on the Uthradam Day during the Onam
festival season for the year 2024. The petitioners also seek to
direct respondents 1 to 4 not to permit any fake organisations to
conduct any boat race without proper verification.
2. W.P.(C) No.36304/2024 has been filed by the
same petitioners seeking to set aside Ext.P1 and to declare that
the petitioners have the fundamental and statutory rights to

carry on their annual Pamba Boat Race competitions and the
3rd respondent has no right to prohibit the petitioners from
conducting the Boat Race. The parties and exhibits are
referred to in this judgment as they are described/marked in
W.P.(C) No.36304/2024.
3. The 1st petitioner states that it is a registered
Society. The local people living on the river banks of Pamba
started the Pamba Boat Race in 1957. In order to streamline
the Boat Race, the organisers constituted the 1st petitioner
-Society in the year 2007 and registered the Society under the
Travancore Cochin Literary, Scientific and Charitable Societies
Registration Act, 1955.
4. Respondents 7 to 9, who were members of the
Society, were ousted from the Society. In the year 2016, they
tried to conduct a similar Boat Race which resulted in law and
order issues. The petitioners approached the Munsiff's Court,
Thiruvalla filing OS No.424/2016 seeking to restrain the
respondents from conducting similar Boat Race. The Munsiff's

Court granted temporary injunction order.
5. In the year 2022, due to floods, the Boat Race
scheduled to the Uthradam Day was postponed to December,
2022. In the yer 2023 also, the major Boat Race competition
was postponed to December, 2023. Respondents 7 to 9,
utilising the said situation, conducted a parallel Boat Race in
September, 2023. The petitioners hence filed OS No.8/2023 in
the District Court, Pathanamthitta. Again, in the year 2024, the
7th respondent organised a Boat Race in September, 2024.
6. The petitioners state that despite the Munsiff's
Court's orders, the 2nd respondent-Executive Engineer, Kollam
Irrigation Division indirectly prohibited the petitioners from
conducting their official Boat Race on 14.09.2024. This Court
passed an interim order in W.P.(C) No.27903/2024 permitting
the petitioners to conduct the Boat Race subject to the decision
of the 3rd respondent-District Collector. The District Collector
passed an order dated 07.09.2024 prohibiting the 1st petitioner
from conducting any Boat Race until further orders.

7. When the said action was challenged by the
petitioners filing W.P.(C) No.32057/2024, the 3rd respondent-
District Collector convened a meeting. By order dated
10.09.2024, the 3rd respondent postponed the date of 7th
respondent's Boat Race from 15.09.2024 to 22.09.2024 on
condition that the petitioner will not be permitted to conduct
Boat Race.
8. The petitioners state that they have a
customary traditional and cultural right to conduct Pamba Boat
Race on the Uthradam Day during every Onam festival.
Ext.P21 order passed by the 3rd respondent is arbitrary and
malafide. The respondents are compellable to permit the
petitioners to carry on with Pamba Boat Race competition.
9. Respondents 6 and 7 resisted the writ
petitions filing counter affidavit. It is the 6th respondent which
has the right to conduct Pamba Boat Race. The 1st petitioner
and others filed IA No.3/2023 in OS No.424/2016 seeking to
restrain the 5th respondent from causing obstruction to the Boat

Race being organised by the 1st petitioner. The Munsiff's Court
dismissed the IA. IA No.2/2023 was filed by the 1st petitioner in
OS No.8/2023 to restrain the respondents from conducting the
Boat Race. The District Court, Pathanamthitta dismissed IA
No.2/2023. The 1st petitioner filed FAO No.103/2024 before this
Court which is still pending. The writ petitions are without any
merit and they are liable to be dismissed, urged respondents 6
and 7.
10. I have heard the learned counsel for the
petitioners, the learned Government Pleader representing the
official respondents and the learned counsel appearing for the
contesting respondents.
11. The dispute arising in these writ petitions
relate to the right to conduct Pamba Boat Race during the
Onam festival. Respondents 6 and 7 would urge that they have
been conducting the Boat Race since the year 1990 registering
their Society. The petitioners in the writ petitions would urge
that they have been conducting the Boat Race and in order to

streamline the functions of Boat Race, they registered a Society
in the year 2007. It is evident from the pleadings and
arguments that there were disputes relating to the conduct of
Pamba Boat Race in the years 2023 and 2024, both sides
claiming superior right over the others.
12. The petitioners have filed OS No.424/2016
seeking to restrain the contesting respondents from conducting
similar Boat Race in the Neerettupuram Water Stadium. The
Munsiff's Court, Thiruvalla has passed certain interlocutory
orders in the said Suit.
13. The petitioners have also filed OS No.8/2023
in the District Court, Pathanamthitta alleging Passing Off under
the Trademarks Act, 1999 and the said Suit is also pending
adjudication before the said Court. Challenging an interlocutory
order, the petitioners have approached this Court and FAO
No.103/2024 is pending consideration before this Court also.
The right of the petitioners and respondents 6 and 7 to conduct
the Pamba Boat Race during Onam festival will have to be

decided by the Civil Courts before which civil suits are pending.
Those disputes cannot be adjudicated in a writ petition under
Article 226 of the Constitution of India.
14. At the same time, conducting of Boat Race
would require statutory permissions from the official
respondents in the writ petitions. It is evident that the disputes
between the petitioners and respondents 6 and 7 have resulted
in law and order issues and even criminal cases have been
filed.
In the facts of the case, while declining the
reliefs sought for in both the writ petitions, the writ petitions are
disposed of directing the 3rd respondent-District Collector to
consider the issue of conduct of Pamba Boat Race for the year
2025 and take appropriate decisions in the matter of conduct of
Boat Race as early as possible and at any rate within a period
of one week positively.
