JUDGMENT
W.P.(C) Nos.1529 of 2025, 21272 of 2024 and 14066 of 2021
are filed seeking a direction to the local authority to take action for the
removal of all illegal encroachers, including respondents 4 to 10, in a time
bound manner. Whereas W.P.(C) No.24235 of 2024 is filed by the street
vendors challenging the order of the Ombudsman for Local Self
Government Institutions wherein a direction was issued to evict them from
the premises they are occupying as on date.
W.P.(C) Nos.1529 of 2025, 21272 of 2024 and 14066 of 2021
2. Petitioner is the same in these three writ petitions, who is
conducting business in C1 room in block No.C of the Chalakudy market
building after executing necessary documents in that regard and on
payment of monthly license fee. The grievance raised by the petitioner is
that in the entrance area and right in front of the building, which also
serves as the compound space and parking area, respondents 4 to 10,

who are the petitioners in W.P.(C) No.24235 of 2024, have set up a street
vending business identical to that of the petitioner and a few other shop
owners. Various complaints are filed, but no action was taken in this
regard. In W.P.(C) No.14066 of 2021 though an interim order was passed
directing the Municipality to ensure that business activities as alleged in
the writ petition without any licence are not conducted inside the market
premises, the same was modified later on as per order dated 02.11.2021
holding that the Municipality has a duty to protect the interest of the
petitioner as well as respondents 4 to 10 and the Municipality was directed
to take necessary steps in this regard.
3. Learned standing counsel appearing for the Municipality would
submit that the Town Vending Committee, as mandated under the Street
Vendors (Protection of Livelihood and Regulation of Street Vending) Act,
2014 (hereinafter referred to as "Act 2014") has taken a decision on
10.11.2022 to relocate the persons including respondents 4 to 10 engaged
in the business of vegetables and dry fish to a place inside the market.
The learned standing counsel would further submit that this Court in the
case of a similarly situated person, taking note of the decision of the Town
Vending Committee to provide a designated place inside the market itself
to the street vendors, issued a direction in W.P(C) No.16905 of 2023 for
shifting of the petitioner therein to the designated place as offered by the
W.P.(C) Nos.14066 of 2021, 21272 of 2024,

Municipality within ten days. Learned standing counsel for the Municipality
would submit that they have also taken a decision on 02.05.2024 bearing
file No.H2-909574/24 to provide to the street vendors including
respondents 4 to 10 a designated space inside the market as a stopgap
arrangement.
4. Learned counsel for the petitioners as well as the learned
standing counsel appearing for the Municipality would submit that going by
Section 3 of the Act 2014 it is the duty of the Town Vending Committee to
conduct a survey of all existing street vendors within the area under its
jurisdiction and the Committee shall ensure that all existing street vendors,
identified in the survey, are accommodated in the vending zones subject to
a norm conforming to two and half percent of the population of the ward or
zone or town or city, as the case may be, in accordance with the plan for
street vending and the holding capacity of the vending zones and that no
street vendor shall be evicted or relocated till the survey is completed and
the certificate of vending is issued to all street vendors. It is submitted that
the survey is almost complete, especially with regard to the area where the
petitioners in W.P.(C) No.24235 of 2024 are doing the street vending
business, and that identity cards were also issued, but the learned
standing counsel appearing for the Municipality would submit that before
issuing the identity cards, a certificate of vending to be issued to the street

vendors as per Section 4 of Act 2014 which has not been given before
issuance of identity cards due to an inadvertent omission.
5. Now the street vendors are confronted with an order issued by
the Ombudsman for Local Self Government Institutions wherein a direction
was issued to the Municipality to evict them from their respective place of
business and the petitioner in W.P.(C) Nos.1529 of 2025, 21272 of 2024
and 14066 of 2021 who is a licensed shop owner inside the market is now
aggrieved by Ext.P8, which is challenged in W.P.(C) No.1529 of 2025,
issued by the Street Vendors Grievance Redressal Committee, wherein an
injunction was granted against the eviction of petitioners in W.P.(C)
No.24235 of 2024.
After considering the rival contentions on both sides and based
on the agreement between the parties, I am of the view that the writ
petitions could be disposed of without entering upon the veracity and
legality of the orders impugned in these writ petitions. The Town Vending
Committee shall issue necessary certificate of vending, which is to be
issued to street vendors after the survey is completed as provided under
Sections 3 and 4 of the Act 2014 to the petitioners in W.P.(C) No.24235 of
2024 without any delay. After issuance of the certificate of vending, the
petitioners in W.P.(C) No.24235 of 2024 will be shifted by the Municipality,
as a stopgap arrangement till the vending zones are identified, to a
W.P.(C) Nos.14066 of 2021, 21272 of 2024,

designated place inside the market run by the respondent Municipality and
they will be permitted to conduct their business activity in the said
designated premises. The learned standing counsel for the respondent
Municipality would submit that necessary arrangements for allotment of
the designated place inside the market as a stopgap arrangement will be
provided within a period of two months from the date of receipt of a copy of
the judgment. The learned standing counsel for the Municipality would
further submit that the petitioners in W.P.(C) No.24235 of 2024 will be
accommodated after the vending zones are identified and the same will be
done without delay after such identification is completed. The said
submission of the learned standing counsel is recorded. Learned counsel
appearing for the petitioners in W.P.(C) No.24235 of 2024 would submit
that on the abovesaid understanding and if action is taken as undertaken
above, they have no objection in being shifted to the designated place
inside the market premises as a stopgap arrangement.
In view of the above, the writ petitions are disposed of.
