                             JUDGMENT

Dated this the 22nd day of June, 2023

This appeal has been preferred by the accused No.1 in

C.C.No.30/2003 on the files of the Court of Enquiry

Commissioner and Special Judge, Kozhikode against the

judgment dated 18.1.2011.

2. The appellant/accused No.1 was convicted and

sentenced to undergo rigorous imprisonment for one year and to

pay a fine of ₹2,000/-, in default to suffer rigorous imprisonment

for five months for the offence punishable under Section 13(2)

read with 13 (1)(c) and (d) of the Prevention of Corruption Act,

1988.

3. The learned counsel for the appellant submits that the

appellant is no more and his legal heirs are not interested to

proceed with the appeal on merits. The counsel further submits

that the legal heirs are prepared to deposit the fine amount as

per the impugned judgment.

The submission is recorded and the appeal is closed. The Crl.A.No.395/2011

legal heirs of the appellant are at liberty to deposit the fine

amount before the learned Special Judge. If the legal heirs fail to

deposit the fine amount, they shall be proceeded with in

accordance with law to realise the fine amount.
