     This Original Petition having come up for orders on 01/08/2023
upon perusing the letter dated 25/07/2023 of the Judge, Family court,
Pathanamthitta requesting extension of time for disposal of
OP(DIV)No.558/2021 and OP No.254/2020 of that court by a further
period of two months from 31/07/2023 and this court's judgment
dated 08/03/2023 in OP (FC) No.720/2022, the court on the same day
passed the following:

                           ORDER

P.G. Ajithkumar, J.

The Judge, Family Court, Pathanamthitta, submitted a

report dated 25.07.2023 seeking extension of time for

disposal of O.P.(Divorce) No.558 of 2021 on the file of that

court for a further period of two months from 31.07.2023.

The Original Petition was disposed of on 08.03.2023 by

directing the Family Court, Pathanamthitta to dispose of O.P.

(Divorce) No.558 of 2021 and the connected cases within a

period of four months. The Judge, Family Court sought

extension of the said period and as per the order dated

15.06.2023 time originally fixed for disposal of O.P.No.558 of

2021 and connected cases was extended till 31.07.2023.

The learned Judge, Family Court would submit that her

tenure is expiring on 31.07.2023 and recording of evidence in

O.P.(Divorce) No.558 of 2021 and the connected cases could

not be completed yet. Extension of time by two months is

sought in such circumstances.

O.P.(FC) No.720 of 2022

It is seen that a new Judge is not taken charge in the

Family Court, Pathanamthitta. Therefore, it may not be

appropriate to fix a fresh period for disposal of the said

original petition and connected cases. The successor in office

of the Family Court, Pathanamthitta shall immediately on

taking charge will report, within which period he/she would

dispose of O.P.No.558 of 2021 and connected cases. With the

said direction this request is closed.
