Writ petition (civil) praying inter alia that in the circumstances
stated in the affidavit filed along with the WP(C) the High Court be
pleased to pass an interim order directing the 2nd respondent to permit
the petitioners to execute agreements in pursuance of exhibits P5 to P10
dispensing with the requirement of furnishing additional performance
guarantee, provisionally.
This petition coming on for admission upon perusing the petition and
the affidavit filed in support of WP(C) and upon hearing the arguments of
M/S.JACOB SEBASTIAN, K.V.WINSTON & ANU JACOB, Advocates for the
petitioners and the STANDING COUNSEL for Respondents, the court passed the
following:
O R D E R
Admit. Learned Standing Counsel takes notice for all the
respondents.
In view of the judgment of this Court in W.P(C)Nos.2558 and 4140 of
2022, there will be an interim order in this Writ Petition directing the
respondents to permit the petitioner to execute agreements without
insisting on providing Additional Performance Guarantee, provisionally and
subject to the outcome of the writ petition.
