JUDGMENT
Petitioner is challenging Ext.P2 and Ext.P4 demand notices
issued by the Kerala State Electricity Board. Petitioner is running two
supermarkets. It was served with the electricity bills for the period
during Covid-19 restrictions. Petitioner has challenged the electricity
bills in this proceedings under Article 226 of the Constitution of India.
2. The remedy of the petitioner is in fact elsewhere. A
writ petition under Article 226 cannot be entertained challenging
electricity bills. Still, having regard to the fact that this Court had
admitted this writ petition and granted an interim stay on condition
that petitioner deposits an amount equivalent to 50% of the demand
in Ext.P2 and P4, I am of the view that this writ petition can be
disposed of granting a breathing time to the petitioner to repay the
balance of the amount demanded in Ext.P2 and Ext.P4.
3. Taking into reckoning the circumstances, especially
those relating to the Covid-19 restrictions, in relation to opening of
shops and commercial establishments, petitioner shall repay the WP(C) NO. 28391 OF 2020
entire balance amount due under Ext.P2 and P4 in six equated
monthly instalments, the first of which shall be payable on or before
30.11.2021. The benefit of this judgment shall not enure to the
petitioner unless the petitioner continues to pay the regular
electricity charges without any default. In the event of default of any
one instalment directed in this judgment, the respondent Board shall
be free to proceed in accordance with law.
The writ petition is disposed of as above.
